Terms and Conditions

1. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install a copy of the App on a mobile device owned or controlled by you
• Access and use the App on such device strictly in accordance with these Terms
• Access and use any content, information and related materials that may be made available through the App

Any use of the App not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

2. Restrictions

You agree not to, and you will not permit others to:

• Modify, reverse engineer, decompile, or disassemble the App
• Create any derivative works based on the App
• Make any copies of the App
• Remove, alter or obscure any proprietary notice on the App
• Use the App for any commercial purpose or for any public display
• Use the App for any illegal or unauthorized purpose
• Use the App to transmit any malicious code
• Use any automated system to access the App
• Attempt to gain unauthorized access to any portion of the App
• Interfere with the proper working of the App

3. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Mazey, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Mazey name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Mazey or its affiliates or licensors. You must not use such marks without our prior written permission.

4. Game Data and Privacy

We do not collect any data. All game progress, scores, and settings are stored locally on your device only. We have no access to this information.

When you delete the App, all local data is permanently removed. There are no accounts, logins, cloud saves, or any form of data collection or transmission.

5. In-App Purchases

The App may offer in-app purchases. If you choose to make an in-app purchase:

• You will be charged through your Apple App Store account
• All purchases are final and non-refundable, except as required by law
• Prices are in U.S. dollars and are subject to change without notice
• You are responsible for any taxes
• If a purchase fails to download or work properly, we will provide a replacement or refund

Apple's payment terms also apply to in-app purchases. You can manage and cancel subscriptions in your Apple App Store account settings.

6. Updates and Availability

We may from time to time develop patches, bug fixes, updates, upgrades, and other modifications to improve the App ("Updates"). Updates may be automatically installed without providing any additional notice or receiving any additional consent.

You consent to these automatic Updates. If you do not want Updates, your only remedy is to delete the App. These Terms will govern any Updates unless the Update is accompanied by a separate license agreement.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy, which confirms that we do not collect, store, or process any personal data whatsoever.

8. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER MAZEY NOR ANY PERSON ASSOCIATED WITH MAZEY MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE APP.

WITHOUT LIMITING THE FOREGOING, NEITHER MAZEY NOR ANYONE ASSOCIATED WITH MAZEY REPRESENTS OR WARRANTS THAT THE APP WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE APP WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.

9. Limitation of Liability

IN NO EVENT WILL MAZEY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless Mazey, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in San Francisco, California, using the English language in accordance with the Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect.

12. Apple App Store Additional Terms

These additional terms apply to the iOS version of the App downloaded from the Apple App Store:

• These Terms are between you and Mazey only, not with Apple
• Apple has no obligation to provide any maintenance or support services for the App
• Apple is not responsible for any product warranties
• Apple is not responsible for addressing any claims relating to the App
• Apple is not responsible for any third-party intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the sole and entire agreement between you and Mazey regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
